A California woman in good health with three children living with multiple sclerosis has died of Covid-19 after a health care provider told her she should not get vaccinated against the virus, her family says.

On behalf of the family, the attorneys said at a news conference that they will file a wrongful death lawsuit against Kaiser Permanente, ABC 7 reports.

Nerissa Regnier, 45, of Mission Viejo, died Dec. 16. She is survived by her husband Devin and her children ages 14, 16 and 29. The family further alleges that she was denied monoclonal antibody treatment when she became ill.

Attorney Annee Della Donna reported that in February 2021, Regnier received a new drug regimen to control her multiple sclerosis, which suppressed her immune system.

When she asked about the covid-19 vaccine, Della Donna says she told the woman she couldn't get it because it contained a "live virus," which is false.

“When you are immunocompromised, you need the covid-19 vaccine,” Della Donna said at a press conference on Wednesday.

Regnier asked to be vaccinated seven times over the next six months and was told each time that she could not receive a "live" vaccine, the attorney alleged.

In August, Regnier finally emailed her neurologist and asked about her vaccinations. The doctor told her that she needed to be vaccinated.

“Two days later, she runs to Kaiser to get the covid vaccine and she feels symptoms, so they test her and she has covid,” Della Donna recounted.

Regnier was given antibiotics and steroids, neither of which are recommended and can be harmful, Della Donna alleges.

Attorney Eric Dubin said the woman's husband took her from Kaiser Hospital in Irvine when she was denied monoclonal antibody treatment and took her to Hoag Memorial Presbyterian Hospital, where he was told it was too late for treatment. .

Regnier was stabilized at the hospital and then taken to Kaiser, where she later died, Della Donna said.

“Twice this husband trusted Kaiser for medical guidance, and twice he was failed,” Dubin added. "It's a devastating case."

Regnier worked as a real estate agent and was a "healthy mom," "very active in the community," according to Della Donna. She had her disease under control thanks to two treatments she underwent each year.

Della Donna added that the family viewed the news conference as a "public service announcement."

“If they tell you that you shouldn't get vaccinated because it's a live vaccine, that's completely wrong. And everyone whose immune system is weakened needs to be vaccinated. That's why we're doing this. We do not want the life of this poor woman to be taken in vain," said the lawyer.

Kaiser Permanente issued a statement expressing deep condolences to Regnier's family.

“While we cannot comment on the personal health information or the specific circumstances of this case, our physicians and health care professionals are dedicated to ensuring that each person treated at Kaiser Permanente receives the highest quality medical care appropriate to their situation. ”, the statement read.

"Treatments for COVID-19 continue to evolve rapidly, and in consultation with each patient, we prescribe care aimed at providing the best clinical outcomes based on current knowledge and their individual needs."

Kaiser Permanente also states: "Furthermore, we have clearly communicated to our members, patients and the public that none of the available COVID-19 vaccines contain live virus and that they are safe and effective."

The health care provider adds that since the vaccines first became available, it has consistently committed to administering them safely and equitably in accordance with all federal and state guidelines.
