LABOR REFORM

The Council of Ministers has approved the Royal Decree Law that includes the agreement reached between the Government, the CCOO and UGT trade union organizations and the CEOE and CEPYME business organizations to structurally reform the labor market. The new regulation will make it possible to cement a labor market in which temporary employment is situated, for the first time, in the environment of European standards.

Through this new Royal Decree Law, the balances lost in collective bargaining are restored, which will recover, once again, its central role in labor relations.

The text also complies with both the government agreement and the commitments made with the European Union embodied in Component 23 and lays the foundations in labor matters for a fair and inclusive recovery.

Collective Bargaining

The new norm recovers indefinite ultraactivity, that is, that the conditions established in a collective agreement will remain in force even after its express validity ends.

The wage prevalence of the company agreement is repealed, avoiding downward wage agreements that break the wage floor of sectoral agreements and, therefore, the wage devaluation that the model in force up to now makes possible.

Stable recruitment as the norm

The contract for work or service disappears. The contracts are presumed concluded for an indefinite period and, therefore, the contracting modalities available are reduced.

In the construction sector, ordinary contracts will also be permanent. The company, once the work is finished, must offer a relocation proposal to the worker, prior development, if necessary, of a training process by the company. If the worker rejects the offer or reasons inherent to it determine the impossibility of relocation, because there is no suitable position, the contract is terminated, with compensation of seven percent calculated on the salary items established in the agreement tables. collective. Both the completion of the work and the extinction must be communicated to the legal representation of the workers.

There will only be a fixed-term contract, which may be entered into due to production circumstances or by substitution of the worker.

Fixed-term contract

To enter into this contract, it will be necessary to specify precisely the enabling cause of the temporary contract, the specific circumstances that justify it and its connection with the expected duration.

Discontinuous permanent contract

It must be arranged for works of a seasonal nature or seasonal productive activities, as well as those that do not have this nature but that, being of intermittent provision, have certain, determined or indeterminate periods of execution.

Workers subject to this type of contract will be a preferential group for training actions. Sectoral agreements may establish employment exchanges to favor their hiring and to improve their training during periods of inactivity.

Outsourcing

A fundamental change is that there will always be an applicable sectoral collective agreement, a decisive question since it allows to cover existing legal gaps up to now.

The applicable sectoral agreement may be that of the activity carried out in the main company or another if so determined by the sectoral collective bargaining within its general rules.

The company agreement may only be applied by the contractor if it determines better salary conditions than the sectoral one that results from application

The new standard regulates, therefore, based on the company's own activity. In the event that essential activities are carried out for the development of the company, the sectoral agreement of the activity carried out by the contractor or subcontractor will be applied to the workers.

Training contracts

There is a change in the model regarding the training contract that will have two modalities: alternating training and obtaining professional practice

The alternating training contract redefines the application, remuneration and time limits to respond to a new object: to acquire the appropriate professional competence corresponding to a certain level of studies (FP, university or catalog of professional qualifications of the National Employment System ).

They can be arranged with people of any age except in the case of the Catalog of Professional Qualifications, with a limit of up to 30 years and will have a maximum duration of two years.

The days will not exceed 65% the first year and 85% the second year without being able to do overtime, shift work or night shifts. The remuneration will be adapted to the agreement and may not go below 60% (the first year and 75% the second year). It will never be less than the SMI proportional to the working day.

A tutor with the appropriate training will be in charge of monitoring the individual training plan that is designed for each person and the correct fulfillment of the object of the contract that they must have.

The specific needs of people with disabilities are also addressed.

The Contracts for obtaining professional practice may be entered into up to a maximum of three (or five years in the case of people with disabilities) after obtaining the certification. They will last between six months and a year.

The remuneration will be that of the agreement for the position except for specific provision and they will also have, as in training, tutorial follow-up.

The protective action of the Social Security of the people who sign a training contract in any of the previous modalities will include the protectable contingencies and benefits including unemployment and the coverage of the Salary Guarantee Fund.

Redesign of disincentives for very short-term contracts

In addition, in the field of contracting, disincentives have been redesigned to penalize excessive turnover in very short-term contracts. Specifically, a penalty or malus of a fixed amount is introduced for each termination of a temporary contract, so that the linear penalty existing up to now is replaced by one that introduces a greater disincentive the shorter the contracts. Temporary contracts of less than 30 days will have an additional Social Security contribution of 26 euros when they are terminated. This also means an increasing penalty (the more short contracts, the greater the disincentive: with a short 10-day contract the penalty would be 26 euros; if the same work time were covered with two five-day contracts, 52 euros…).

Exceptionally, this contribution will not be applied to the special regimes for agricultural workers, domestic employees, coal mining, and neither to substitution contracts.

Internal flexibility

In addition, the reform includes the implementation of new mechanisms to promote internal flexibility in companies, with the aim of promoting the continuity of stable labor relations, avoiding transit through unemployment, which benefits both workers as companies. In this way, the existing ERTE model is reviewed and the RED mechanism is created.

The changes introduced aim to make it easier to process and more flexible in its application, especially for SMEs. Thus, the consultation period is reduced to seven days for companies with less than 50 workers, after setting up a representative commission.

The information to the representation of the workers during the application of the ERTE is reinforced. The prohibitions on overtime and outsourcing of the current ERTE COVID are incorporated.

To the classic force majeure is added, as a specific cause, the impediment or the limitations to the normalized activity determined by decisions of the governmental authority.

They will require a mandatory report from the Labor Inspectorate. The labor authority must resolve in five days, with positive silence. The reduction in working hours will be between 10 and 70 percent. During the period of validity of the ERTE, the company may affect and dismiss workers (as in the ETOP ERTE) prior information to the legal representation of the workers and communication to the General Treasury of Social Security. They maintain the employment guarantees of the current ERTE COVID.

For both modalities, several new elements are incorporated, gathered from the experience of the pandemic: the possibility of assigning or disassociating workers depending on the activity of the company, increasing the flexibility of these instruments; the possibility of obtaining bonuses in social contributions and financing if they carry out training activities for workers in ERTE; and exemptions in Social Security contributions. In the case of the ERTE ETOP they will be 20%, conditioned to the performance of training actions, and in the case of those of Force Majeure, 90%. They will be linked to the maintenance of employment of the current ERTE COVID and companies will see an increase in the credit available for training.

It must be activated by the Council of Ministers, after informing the most representative organizations, at the proposal of Economic Affairs and Digital Transformation; Work and Social Economy and Inclusion, Social Security and Migrations; that is in charge of opening the door but not deciding whether the companies, individually, can be accepted. The labor authority will give the green light if the company has developed a consultation period and if there are concurrence of causes, therefore, the reasons must be justified. 2 modalities:

Cyclical: it will provide companies with a stable framework in the event of a temporary or cyclical drop in their demand due to macroeconomic causes, to avoid immediate dismissals due to the shock. Companies may suspend part of their workers for a maximum period of one year instead of firing them. During this period of suspension, the training of workers will be encouraged and exemptions are established in Social Security contributions that decrease over time.

Sectoral: the most representative trade union and business organizations may request the convening of the Tripartite Commission of the RED Mechanism. In this case, it will be accompanied by a requalification plan. This modality provides support for the requalification of workers from companies and sectors in transition that require permanent changes. In this case, to avoid traditional employment adjustment, the company can activate this mechanism for a maximum period of one year (six months, with the possibility of extending another six months) and facilitate the transfer of its workers to another company through their requalification. . For this, in addition, the destination company will access a 50% bonus for six months.

Audit on the results

The Government will carry out an evaluation of the results obtained by the planned measures through the analysis of the data of temporary and indefinite hiring in January 2025, proceeding to the official publication, for these purposes, of the general temporary rate and by sectors, an evaluation that must be repeated every two years.

IMPROVEMENTS IN THE GUADIANA BASIN

The Council of Ministers has approved the conclusion of the service contract for the improvement of the state of the channels associated with irrigable areas of general interest to the State that the Guadiana Hydrographic Confederation is assigned within its powers.

These works aim to promote savings, efficiency and sustainability in the use of water resources in this demarcation. The estimated duration of the contract is 2 years and its estimated value is 16,527,712 euros.

The actions will take place in the Zújar, Orellana, Las Dehesas, Lobón and Montijo canals. These infrastructures accumulate several decades since their commissioning and require urgent actions to mitigate the losses they suffer and guarantee sustainable and responsible use of water in agriculture, ensuring the good condition of rivers, aquifers and wetlands.

The works are divided into three blocks that affect: Canal del Zújar; Orellana Canal and Las Dehesas Canal and, finally, Lobón Canal and Montijo Canal. For each of the three lots, the tasks to be carried out include, on the one hand, normal maintenance and conservation operations for the ordinary exploitation of the system, which may be planned and executed at the end of the irrigation campaign, between the months of October and March. and which include measures aimed at saving water, the conservation and maintenance of these infrastructures and the improvement of their efficiency.

And on the other hand, actions are contemplated that cannot be planned in a preventive way and that obey both meteorological issues and failures in the infrastructure network at any time of the year, making action urgent.

UPDATE OF THE HYDROLOGICAL PLANNING REGULATION

The Council of Ministers has approved a royal decree that modifies the Regulation of the Hydrological Planning to update the requirements and procedures that will be taken into account for the next hydrological basin plans -which were in public consultation until last December 22-- and the special drought plans.

This new regulation, the main normative reference in hydrological planning, updates the one that was approved in 2007 with the aim of adjusting to the lines of the European Green Pact and, in general, to the national and international policies adopted in the matter of water in recent years.

Among the main novelties, the modification of the Hydrological Planning Regulation includes the regulation of special drought plans to indicate their minimum required contents and their preparation, processing, approval and review procedures. It also highlights the consideration of climate change in the new hydrological planning cycle, the harmonization of the regulatory contents in the plans for the entire territory and the updating of the publication and notification requirements of these documents to the European Union, adapting to the new Information technology and communications.

After fourteen years of validity of the previous regulation, its update represents a fundamental qualitative leap, since it integrates into the very heart of hydrological planning the need to adapt to the effects of climate change and take environmental limits into consideration.

The new regulation also clarifies and reinforces the criteria to justify the exemptions to the achievement of environmental objectives, especially when it comes to promoting new modifications of the physical characteristics of the bodies of water, and establishes the programs of measures that must be promote each of the competent administrations, both for the hydrological plans and for specific actions (works, studies and works) with associated investment budget.

The third-cycle hydrological plans, which will be approved in the coming months, will benefit in the short term from this regulatory change, since it formally establishes what until now had been coordination instructions issued by the General Directorate of Water. The new regulation will allow, among other things, that hydrological planning be coherent throughout the Spanish territory, correcting the problem detected in some opinions of the Council of State that warned about the dispersion of regulations between the different demarcations.

Recovery, transformation and resilience plan

This modification, which has had a broad participatory process, fundamentally affects inter-community basins, but also helps the proper channeling of the notification exercises of all Spanish hydrological plans before the European Union.

The update is part of a package of reform actions agreed with the European Commission within component 5 on coastal space and water resources of the Spanish Recovery, Transformation and Resilience Plan.

COOPERATION WITH SMES IN SOUTH AMERICA

The Council of Ministers has approved the agreement authorizing the acquisition of Andes Plus Fund shares I, L. P., charged to the Development Promotion Fund, for a maximum amount of US$7,000,000.

The Fund for the Promotion of Development (FONPRODE) is regulated by Law 36/2010, of October 22, and by Royal Decree 597/2015, of July 3, which approves the FONPRODE Regulations. The operation proposed by this Agreement is framed within the provisions of Article 53 of Law 11/2020, of December 30, on the General State Budget for the year 2021 (LPGE) and Article 2.3 h) of said Law 36/2010 .

This Agreement proposes the acquisition of shares of Andes Plus Fund I, L. P. charged to the Fund for the Promotion of Development, with the following conditions:

The objective of the Agreement is to provide financing to SMEs that provide goods and services to underserved local communities, and/or generate jobs and sustainable income in these communities through their inclusion in the value chain as suppliers, retailers, employees or consumers, as well as helping these companies achieve scale and long-term sustainability, promoting a gender approach.

Its geographic focus will be Colombia and Peru. Should the Fund's total commitments exceed USD 30 million, the geographic focus could be expanded through specific operations in Bolivia, Paraguay or Ecuador.

The Fund has a gender equality approach, so priority will be given to companies owned by women, with diverse management teams and that practice gender equality at all levels of their organization.

This operation is aligned with the priorities of Spanish Cooperation in the region. The V Master Plan for Spanish Cooperation 2018-2021 establishes that FONPRODE will give preference in its operations to the Association Countries. Likewise, it establishes that special attention will be paid to interventions in microfinance, banking remittances, small and medium-sized enterprises, social economy, venture capital, infrastructure creation and APPD (Public Private Development Alliances).

The Fund's target countries are located in Latin America, a priority region according to the V Master Plan for Spanish Cooperation.

The operation is consistent with the objectives of Spanish Cooperation, contributing to the achievement of the following Sustainable Development Goals (SDGs): SDG 1. End of poverty, for its contribution to the integration of disadvantaged communities in the production chains; SDG 5. Gender equality, for its promotion of female leadership and equal access to jobs and promotions; SDG 8. Decent work and economic growth, for the promotion of quality employment generation; SDG 10. Reduction of inequalities, for the contribution to the integration of communities and promotion of gender equality and SDG 12. Responsible production and consumption, for the promotion of sustainable production and consumption.

At the XLVII session of the Executive Committee of FONPRODE, held on November 11, 2021, it was agreed, in accordance with the provisions of Article 16.6 of the FONPRODE Regulations, to submit to the Council of Ministers, the authorization for the acquisition of shares in Andes Plus Fund I, L.P., charged to the Development Promotion Fund, for a maximum amount of US$7,000,000.

The proposed Agreement of the Council of Ministers regarding the operation was reported by the Government Delegate Commission for Economic Affairs at its session on December 10, 2021, in accordance with the provisions of Article 2.3.h) of the Law 36/2010 and in Article 16.5 of the FONPRODE Regulations.

COOPERATION WITH CENTRAL AMERICA AND THE CARIBBEAN

The Council of Ministers has approved an agreement authorizing the granting of a loan for a maximum amount of 3,000,000 US dollars for the Inclusion of microenterprises in Central America and the Caribbean, S.A., (SICSA), charged to the Fund for the Promotion of Development.

The Fund for the Promotion of Development (FONPRODE) is regulated by Law 36/2010, of October 22, and by Royal Decree 597/2015, of July 3, which approves the FONPRODE Regulations. The proposed operation is part of the provisions of Law 11/2020, of December 30, on the General State Budget for the year 2021 (LPGE) and Law 36/2010, of October 22.

Through this Agreement it is proposed that the Council of Ministers authorize the granting of a loan for a maximum amount of 3,000,000 US dollars to SICSA, charged to the Development Promotion Fund, to finance the expansion of its portfolio , with the following conditions:

In 2006, at the initiative of the Central American and Caribbean Microfinance Network (REDCAMIF), SICSA was established with the corporate purpose of offering services to national microfinance networks that support micro, small, and medium-sized enterprises in the region.

The V Master Plan for Spanish Cooperation 2018-2021 (V PD) indicates that FONPRODE must pay special attention to interventions in microfinance, bank transfer of remittances, small and medium-sized enterprises, social economy, venture capital, infrastructure creation and Public-Private Partnerships for Development (APPD). The geographic scope of SICSA is the Central American and Caribbean region. All the countries in which resources from this operation will be placed are classified in the V PD as Association Countries, mainly actions in Middle Income Association Countries: El Salvador, Guatemala, Honduras, Nicaragua and the Dominican Republic; although there will also be an exhibition in Advanced Cooperation Countries: Costa Rica and Panama.

The operation contributes to the achievement of the Sustainable Development Goals (SDG) and the goals prioritized by the EC. The alignment with SDG 8 (Decent Work and Economic Growth), SDG 1 (Poverty reduction) and SDG 5 (Gender equality) stands out. The operation would support the livelihood of 18,459 jobs in MSMEs in the region, therefore, proportionally, FONPRODE could be attributed during the life of the operation (December 2021 - December 2029) the support of just over 16,000 jobs in MSMEs serviced with credit. It will also contribute to SDG 1 and target 4 prioritized in the V PD of "access to finance for all people, including the most vulnerable".

In accordance with the provisions of Article 2.3.g) of Law 36/2010, of October 22, and Article 16.5 of the FONPRODE Regulations, this operation has been submitted for evaluation by the Delegate Commission of the Government for Economic Affairs prior to its submission to the Council of Ministers.

In view of the foregoing, at the XLVII session of the Executive Committee of FONPRODE, held on November 11, 2021, in accordance with the provisions of Article 16.6 of the FONPRODE Regulations, it was agreed, through the Ministry of Foreign Affairs, European Union and Cooperation, submit to the Council of Ministers the authorization of a CICSA loan, charged to FONPRODE, for a maximum amount of 3,000,000 US dollars.

COOPERATION WITH EL SALVADOR

The Council of Ministers has approved an agreement authorizing the granting of a loan for a maximum amount of 15,000,000 US dollars to Banco Azul de El Salvador S.A., charged to the Development Promotion Fund.

The Fund for the Promotion of Development (FONPRODE) is regulated by Law 36/2010, of October 22, and by Royal Decree 597/2015, of July 3, which approves the FONPRODE Regulations. The proposed operation is part of the provisions of Law 11/2020, of December 30, on the General State Budget for the year 2021 (LPGE) and Law 36/2010, of October 22.

Through this Agreement it is proposed that the Council of Ministers authorize the granting of a loan for a maximum amount of 15,000,000 US dollars to Banco Azul de El Salvador S.A., charged to the Fund for the Promotion of Development, to finance the expansion of its portfolio, with the following conditions:

The Banco Azul entity originated from the initiative of a group of Salvadoran investors. In September 2013, it received authorization from the Superintendence of the Financial System of El Salvador and was established as a bank. Its corporate purpose is financial intermediation, focused on active and passive operations, both for individuals and legal entities. Its mission is to contribute to the development of the country through the provision of financial services and personalized attention. The entity has the objective of consolidating itself in the Salvadoran banking sector as a medium-sized entity.

The loan to Banco Azul seeks to contribute to increasing the credit portfolio aimed at small and medium-sized companies in all productive sectors of El Salvador, as well as to finance clean energy projects, thus contributing to economic, social and environment of the country.

The V Master Plan for Spanish Cooperation 2018-2021 indicates that FONPRODE will pay special attention to interventions in microfinance, banking remittances, small and medium-sized enterprises, social economy, venture capital, infrastructure creation and Public-Private Alliances for Development (APPD). Likewise, it includes El Salvador among the Middle Income Association countries, in which the Spanish Cooperation (CE) intends to be a means to leverage resources, establish relationships and institutional collaborations and catalyze other actions. In these countries, financial cooperation and blending are of particular importance to the EC; In addition, the cooperation will focus on building resilience, as well as support in their transition towards sustainable production models.

The operation contributes to the achievement of the Sustainable Development Goals (SDG) and the goals prioritized by the EC. The alignment with SDG 8 (Decent Work and Economic Growth) and SDG 7 (Affordable and clean energy) stands out. The operation would support the livelihood of more than 45 thousand jobs. The contribution attributed to the financing of FONPRODE during the life of the loan (2022-2030) would contemplate the support of at least 1,000 jobs. Additionally, the contribution to SDG 7 can be contemplated through the financing of projects aimed at financing the implementation of energy efficiency systems and sustainable resource management.

In accordance with the provisions of Article 2.3.g) of Law 36/2010, of October 22, and Article 16.5 of the FONPRODE Regulations, this operation has been submitted for evaluation by the Delegate Commission of the Government for Economic Affairs prior to its submission to the Council of Ministers. In view of the foregoing, at the XLVII session of the Executive Committee of FONPRODE, held on November 11, 2021, in accordance with the provisions of article 16.6 of the FONPRODE Regulations, it was agreed, through the Ministry of Foreign Affairs, European Union and Cooperation, submit to the Council of Ministers the authorization of a loan to Banco Azul de El Salvador S.A. VOLUNTARY CONTRIBUTION TO THE GLOBAL AGRICULTURE AND FOOD SECURITY PROGRAM (GAFSP)

The Council of Ministers has approved the agreement authorizing the Spain's voluntary contribution to the Global Agriculture and Food Security Program (GAFSP), in the amount of 5,000,000 euros.

The Global Agriculture and Food Security Program (GAFSP) was born in 2010 as one of the global initiatives of the G-20 -in the field of food security- to mitigate the global crisis of food price volatility. It was mainly promoted by the United States, Canada, Spain (USD 94.2 million contributed, 7th donor in accumulated terms) and the Gates Foundation, and its objective is to improve food security, nutrition and agri-food income of the most disadvantaged population in least developed countries, IDA countries being eligible.

GAFSP works as a Global Fund, administered by the World Bank, and to date it has been structured in two windows, one public and one private, which will be combined from now on to optimize the impact of the resources that finance it. in what has been called the GAFSP 2.0. The program works with agents from the public and private sectors, with civil society organizations and with United Nations Agencies and Regional Development Banks, the latter being the supervising entities of the projects. Over the years, GAFSP has channeled more than $1.7 billion to fight hunger, malnutrition, and poverty in more than 40 low-income countries.

Currently, to minimize the impact of the COVID-19 pandemic on the food safety system, it is important to protect the flow of food and agricultural products in the world, guarantee the functioning of supply chains, manage shortages of labor and income losses, and increase access to affordable and nutritious diets.

With this objective, the President of the Government announced -in the framework of the Global Goal: Unite for our Future event on June 27, 2020- the contribution of 10,000,000 euros to the GAFSP, as an unequivocal sign of our country's commitment with the international effort in the fight against COVID-19. The contribution will be made in two payments of 5,000,000 euros each, the first corresponding to the year 2021.

VOLUNTARY CONTRIBUTION TO THE NETWORK OF NATIONAL INSTITUTES OF CULTURE OF THE EUROPEAN UNION

The Council of Ministers has approved an agreement whereby the authorizes the voluntary contribution of Spain to the Network of National Institutes of Culture of the European Union, amounting to 400,000 euros.

The Network of National Institutes of Culture of the European Union (EUNIC) is a European network of national cultural institutes and agencies that operates in numerous countries promoting collaboration between European organizations and local partners and the dissemination of European culture. On the Spanish side, the Cervantes Institute and the Spanish Agency for International Development Cooperation (AECID) are full members, which joined the network in 2015.

As a member of EUNIC, the AECID actively participates in the network supporting European collaboration in the field of culture through its network of Spanish Cultural Centers and Diplomatic Missions in more than 80 locations around the world, and in particular in Latin America and Sub-Saharan Africa. Likewise, the AECID also participates in the EUNIC network in the advancement of culture and sustainable development.

At the EUNIC General Assembly held in October 2020, the current Director of Cultural and Scientific Relations of the AECID, Guzmán Palacios Fernández, was elected, among his counterparts, president of EUNIC for the period 2021-2022.

During the EUNIC General Assembly held in Toledo on June 10 and 11, 2021, the AECID formally assumed its presidency and a bi-regional meeting was held with the Ibero-American counterparts of the Ibero-American Network for Cultural Diplomacy (RIDCULT). Upon completion, EUNIC and RIDCULT signed a Joint Declaration to deepen the bi-regional dialogue on culture and collaborate in promoting their shared values.

In order to achieve this objective, the AECID proposes making a voluntary contribution to EUNIC in the amount of 400,000 euros that would be used to finance EUNIC initiatives within the framework of the AECID presidency, among which are the EUNIC Cluster Fund and a fund to deepen the Euro-Latin American cultural dialogue.

-The Cluster Fund was established in 2012 and since then has funded 145 projects through an annual call open to EUNIC clusters worldwide. The budget of each call is based on voluntary contributions from the headquarters of EUNIC members. The 2021 Cluster Fund call establishes a thematic focus on the Sustainable Development Goals (SDGs), so that the projects that are selected among those sent by the clusters are those that contribute, through culture, to the achievement of the SDGs .

EUNIC requested on November 23, 2021 the payment of 400,000 euros as a Spanish contribution to the activities carried out during the AECID presidency. The accession of Spain to EUNIC constitutes the regulations that cover the Spanish voluntary contribution to EUNIC.

COOPERATION WITH NIGER

The Council of Ministers has authorized two operations linked to the Fund for the Promotion of Development whose recipient is the Republic of Niger.

On the one hand, the agreement authorizing the granting of a loan to the Republic of Niger, charged to the Fund for the Promotion of Development, for a maximum amount of 10,000,000 euros.

On the other, the agreement authorizing the payment of up to US$445,000 to the International Fund for Agricultural Development, charged to the Fund for the Promotion of Development, for the preparation and supervision of the "Project to Strengthen the Resilience of rural communities to food and nutrition insecurity in Niger (PRECIS)", co-financed with a credit of up to 10,000,000 euros granted by said Fund to the Republic of Niger.

The Fund for the Promotion of Development (FONPRODE) is regulated by Law 36/2010, of October 22, and by Royal Decree 597/2015, of July 3, which approves the FONPRODE Regulations.

The operations proposed by these Agreements are framed within the provisions of Article 53 of Law 11/2020, of December 30, on the General State Budget for the year 2021 (LPGE) and Articles 2.3.e) and 2.4 of the aforementioned Law 36/2010.

EXTENSION OF ADAPTATION MEASURES FOR BREXIT

The Council of Ministers has approved the agreement extending the measures contained in the Articles 11 and 15 of Royal Decree-Law 38/2020, of December 29, which adopts measures to adapt to the situation of Third State of the United Kingdom of Great Britain and Northern Ireland after the end of the transitional period provided for in the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, of January 31, 2020.

On January 31, 2020, the United Kingdom ceased to be a Member State of the EU and became a third country, after the ratification of the Agreement on the Withdrawal of the United Kingdom from the European Union and the European Community of Atomic Energy (Withdrawal Agreement), which provided for a transitional period from its entry into force until December 31, 2020.

For this reason, Spain approved Royal Decree-Law 38/2020, of December 29, which adopts measures to adapt to the situation of a third State of the United Kingdom of Great Britain and Northern Ireland, after the completion of the transitional period provided for in the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, of January 31, 2020.

Article 2 of Royal Decree-Law 38/2020 determines that the measures provided for therein, subject to a period of validity, will cease to be in force by the mere expiration of said period, unless the Government, through agreement, proceed to extend it. By virtue of said article, by means of the Agreement of the Council of Ministers of June 22, 2021, some of these measures, which were about to expire on June 30, 2021, were extended for an additional period of four months. Subsequently, by Agreement of the Council of Ministers on October 26, 2021, a new extension of the measures provided for in Articles 11, 12 and 15 was established for an additional period of two months, until December 31, 2021.

The validity of said extension is about to expire on December 31, 2021, it is considered necessary to extend for an additional period of six months, until June 30, 2022, the validity of the periods provided in Articles 11 and 15 of Royal Decree-Law 38/2020. Consequently, through this Agreement the following measures included in Royal Decree-Law 38/2020 are extended:

However, these measures will cease to apply if, prior to the expiration date of their validity, an agreement between the European Union and the United Kingdom on Gibraltar enters into force that includes access to healthcare within its scope. material scope of application.

VOLUNTARY CONTRIBUTION TO UNITAID

The Council of Ministers has approved the agreement authorizing Spain's voluntary contribution to Unitaid, by amount of 2,000,000 euros.

The proposed contribution goes to Unitaid, an international medicine procurement service created by agreement between the World Health Organization (WHO) and several states, with the aim of expediting access to diagnostic methods and medicines quality in the fight against HIV/AIDS, tuberculosis and malaria in the most affected developing countries.

WHO is Unitaid's host organization and places at its disposal its Secretariat, the Trust Fund, administrative and fiduciary support and the relevant facilities for the proper development of its work.

Spain adhered to the memorandum of understanding between the Federative Republic of Brazil, the French Republic, the Republic of Chile, the Kingdom of Norway, the United Kingdom of Great Britain and Northern Ireland and the World Health Organization on May 8, 2007, being the only country along with South Korea that, apart from the five founders, has the right to appoint a member of the Board of Directors.

We are currently in a moment of urgency and health crisis caused by the COVID-19 pandemic. In this context, the initiative to accelerate Access to tools against COVID-19 (ACT-A) has been developed, whose founding countries include Spain. It is an international collaboration framework that brings together governments, health organizations, scientists, companies, civil society organizations and philanthropists, and whose objective is to accelerate the development and production of tests, treatments and vaccines against COVID-19. 19 and equitable access to them, as well as strengthening national health systems so that they can apply the products developed. ACT-A as a whole is framed in the Plan of the World Health Organization (WHO).

One of the pillars on which this Plan is structured is the treatment pillar, led by Unitaid, and whose purpose is to advance research into effective treatments and support countries to optimize clinical care.

The President of the Government announced, during his speech at the 76th United Nations General Assembly in September 2021, Spain's support for Unitaid with a contribution of 2 million euros as a sign of our country's unequivocal commitment to the effort in the fight against Covid-19, reinforcing the role of the treatment pillar within ACT-A.

TRANSFER TO THE MINISTRY OF CULTURE AND SPORTS TO PROMOTE THE AUDIOVISUAL SECTOR

The Council of Ministers has approved an Agreement authorizing a credit transfer from the budget of the Ministry of Economic Affairs and Digital Transformation to the Ministry of Culture and Sports for actions to promote the audiovisual sector for an amount of 9 million euros, within the framework of Component 25, Investment 1, of the Recovery, Transformation and Resilience Plan .

The Secretary of State for Telecommunications and Digital Infrastructures has initiated a credit transfer file, amounting to 9 million euros, to the Ministry of Culture and Sports, with repercussions on the Institute of Cinematography and Audiovisual Arts (ICAA).

The purpose of this file is to promote the Spanish audiovisual industry, increase the competitiveness of the sector, favor its development at the pace set by global growth and, thus, position itself as an international hub for the production of audiovisual content. Specifically, the Recovery, Transformation and Resilience Plan (PRTR) includes in Component 25, Investment 1, the so-called 'Audiovisual Hub. Plan to Promote the Audiovisual Sector', a Plan that is also one of the axes of the España Digital 2025 Agency.

The Ministry of Economic Affairs and Digital Transformation and the Ministry of Culture and Sports participate in the implementation of this Plan, through the Institute of Cinematography and Audiovisual Arts through an investment of 100 million euros in both cases.

In the 2021 General State Budget, an endowment of 109 million euros was approved to the Ministry of Economic Affairs and Digital Transformation for the execution of Component 25 and, in the PRTR, 100 million euros are assigned to it in 2021 for this concept, while the remaining 9 million must be executed by the Ministry of Culture and Sports.

That is why the credit transfer approved today by the Council of Ministers for an amount of 9 million is necessary from the 'Hub audiovisual' application. For the implementation of this new project, which will begin on January 1, 2022, INTA requires the support of a Comprehensive Project Management Office (PMO). Due to the lack of sufficient technical means, it is necessary to process an assignment to ISDEFE, a company that is considered its own means and technical service of the General State Administration and the entities, entities and organizations dependent on it. NEW PUBLIC EXPENDITURE REVIEW CYCLE FOR THE 2022-2026 PERIOD

The Council of Ministers has approved the new public spending review cycle 2022- 2026 and has formalized phase I of the same cycle.

Specifically, the Government, after consulting AIReF, has approved a new multi-annual framework (2022-2026) for the public spending review process ('Spending Review'), which responds to milestone 400 of the Annex to the Execution Decision of the Council of the Recovery, Transformation and Resilience Plan (PRTR).

This new public spending review cycle will be carried out by specific areas of spending and by phases. Specifically, the Ministry of Finance and Public Function has identified the following areas to be analyzed in this new multi-year cycle:

First phase of the new public spending evaluation cycle

By virtue of the same Agreement, the Council of Ministers has formalized the first phase of this new cycle of 'Spending Review', determined by the first two areas of analysis.

First of all, the evaluation of the financial instruments of the public sector to support the productive sectors will be carried out. These are measures in the economic field that have sought to protect and support the productive fabric, minimize the impact derived from the crisis caused by COVID-19 and that the recovery of activity occurred as soon as possible. The evaluation of these instruments will help to strengthen their role in supporting key sectors of the economy. This phase will complement the study already begun by AIReF corresponding to the third phase of the first cycle of the public administration spending review process.

The second area of ​​review that will be analyzed in the first phase refers to the expense derived from the assistance of administrative mutualism. Mutual societies for civil servants, in their capacity as managers of the aforementioned Special Social Security Regime, provide their mutual members and beneficiaries, among other services, health care, in accordance with the provisions of their regulatory laws approved by Royal Legislative Decree 4/ 2000, of June 23.

The works corresponding to the first phase of the 'Spending Review' will begin in 2022. AIReF must prepare and present an Action Plan within three months that specifies, among other things, the methodology to be used and a schedule of performances. Once the Ministry of Finance and Public Function approves this Plan, AIReF must present the results of the study within a maximum period of twelve months.

First cycle of the 'Spending Review'

The first cycle of the public spending review process, also called the 'Spending Review', began in 2017 and was carried out by specific areas of spending and in phases.

The first phase of analysis entrusted to the Independent Authority for Fiscal Responsibility (AIReF) focused on public subsidies.

Subsequently, in the second phase, four areas of spending were reviewed: tax benefits, hospital spending of the National Health System, incentives for contracting and transport infrastructure of all Public Administrations.

Finally, in 2021 the third and last phase focused on the review of public sector financing instruments to support the productive sectors of the Spanish economy and urban waste management has been formalized. With the aforementioned study of the third phase, the first multi-year review cycle of Public Administration spending is closed, the results of which are expected in the first half of 2023.

Commitment to the Recovery, Transformation and Resilience Plan

The Government's commitment to transparency, improving the quality of public spending and reinforcing budgetary stability and the sustainability of public finances is still valid, as reflected at the beginning of this new cycle and as it remains included in the Recovery, Transformation and Resilience Plan (PRTR). Specifically, its component 29 is dedicated to improving the effectiveness of public spending. Within it, the reform 1 'Process of review and evaluation of public spending' is framed. This reform aims to improve the quality of public spending, in particular by reviewing its composition and reorienting its use, to favor economic growth and job creation and, ultimately, ensure budgetary stability and reaffirm the sustainability of public debt in the medium term.

OPERATION CHARGED TO THE BUSINESS SOLVENCY SUPPORT FUND

The Council of Ministers has authorized the granting of a new temporary public support operation, for an amount of 30 million euros, requested by the Soho Boutique Hotels Group, a tourism company that manages 28 hotel establishments.

This authorization occurs after the Management Board of the Fund to Support the Solvency of Strategic Companies has approved said financial support. This aid will be channeled through a participatory loan for an amount of 24 million and an ordinary loan of 6 million.

The operation has been approved after an exhaustive and rigorous process of analysis of the economic and legal situation of the company, the impact it has suffered from COVID-19, the feasibility plan presented by the Soho Group, as well as of the prospects for evolution and of the guarantees provided to ensure the repayment of the temporary public financial support that it will receive.

The aid comes from the aforementioned Support Fund, endowed with 10,000 million euros. This mechanism was approved by the Government in July 2020 with the aim of providing temporary public support to strengthen the solvency of non-financial companies affected by the COVID-19 pandemic that are considered strategic for the national or regional productive fabric. The extension agreed by the European Commission extends the field of application of the Temporary Framework for state aid until June 30, 2022.

The Council of Ministers has approved an agreement modifying the limits of spending, charged to future years, as established in article 47 of the General Budgetary Law, so that the Ministry of Foreign Affairs, European Union and Cooperation carry out remodeling and conditioning works of the headquarters of the permanent representation of Spain before the EU, in Brussels.

The Permanent Representation of Spain to the European Union in Brussels (hereinafter REPER-UE) has its administrative headquarters in the so-called Spain complex, made up of 4 adjacent buildings.

Taking into account that during the second half of 2023 Spain will hold the Presidency of the Council of the European Union, it is essential to remodel these spaces, specifically several floors of the Ducale building, expanding and conditioning them, which will allow improve its layout and functionality.

According to the project carried out, the corresponding work file will have an estimated cost of 472,679.5 euros, with an expected execution of between five and six months throughout the year 2022, although it intends to start anticipated in the present fiscal year.

MODIFICATION OF THE ECONOMIC AND FISCAL REGIME OF THE CANARY ISLANDS

The Council of Ministers has approved a Royal Decree-Law that modifies the Economic and Fiscal Regime (REF) of the Canary Islands to adapt it to the Regional Aid Map.

Spain notified the European Commission on December 1, 2021 of its Map of Regional Aid for the period 2022-2027, so it is necessary to modify several temporary references contained in Law 19/1994, of 6 July, of modification of the Economic and Fiscal Regime of the Canary Islands, so that the legal references have the same temporal scope as the period of validity of the community regulations.

Likewise, the validity of the Canary Islands Special Zone (ZEC) is extended until the new term of validity of the Regional Aid Map.

This modification is intended to eliminate the legal uncertainty that maintenance of the terms mentioned in the current legal wording could generate for economic operators.

RAIL NETWORK MAINTENANCE DEPENDENCIES

The Council of Ministers has authorized the Ministry of Transport, Mobility and Urban Agenda (Mitma) to tender , through Adif, a contract to carry out improvement and maintenance tasks in the buildings, offices and facilities linked to the conservation and maintenance tasks of the railway network.

The contract, which has a value of 19,768,800.00 euros (without VAT) and a period of 24 months, includes a total of 1,260 dependencies and buildings linked to the conservation activity that Adif has, distributed throughout the the network, of which 561 correspond to the high-speed network.

This action is being tendered divided into seven lots. Six of them cover the dependencies linked to the conservation works of the conventional railway network and the metric gauge network, grouped according to their different geographical location.

For its part, the seventh lot includes all the buildings and facilities associated with the work of upkeep and maintenance of the high-speed network.

Optimization of facilities

The contract contemplates the carrying out of works and works for the optimization of these facilities, as well as the maintenance of all of them. The objective is to guarantee its full availability to undertake the conservation and maintenance works of the railway network in the best conditions of quality and reliability.

The scope of the contract also includes all the construction elements and facilities and endowments of the different buildings, premises, auxiliary buildings and the plots or outdoor spaces that they have. In addition, it includes the resolution or repair of eventual incidents or breakdowns within the periods indicated.

This contract contributes to the achievement of the Sustainable Development Goals (SDG), such as number 9, which has among its goals the promotion of sustainable, reliable and quality infrastructures.

AGREEMENT FOR THE ERMINION LINK

The Council of Ministers has authorized the signing of an agreement between the Ministry of Transport, Mobility and the Urban Agenda (Mitma) and the Provincial Council of Araba for the financing and execution of works to increase the capacity of the access branches, in both directions, of the connection of the current AP-1 with the A-1 at the Armiñón junction.

On November 30, 2018, the AP-1 Burgos-Armiñón highway became toll-free. In addition, by means of Royal Decree 1414/2018 (BOE of December 5, 2018) the ownership of the section of AP-1 between the provincial limit of Burgos (P.K. 77.2) and the Armiñón junction (P.K. 83.2) was transferred. to the Autonomous Community of the Basque Country, being the powers in road matters in this case assumed by the Provincial Council of Araba, in accordance with the Statute of Autonomy of the Basque Country.

The Mixed State-Basque Country Transfer Commission of November 26, 2018 agreed that the actions aimed at expanding the capacity of the connection link between the A-1 and the AP-1 in Armiñón (Araba) would be agreed by means of a agreement, which today is authorized by the Council of Ministers, assuming its financing by the State Administration.

Technical characteristics

The release of the toll payment on the AP-1 makes it necessary to improve road safety and comfort conditions for users of the current Armiñón link, which is the connection point between the until now AP-1 and the A-1 (Vitoria-Gasteiz highway).

The actions will contemplate the expansion of the capacity of the access branches in both directions of circulation of the connection of the current AP-1 with the A-1 at the Armiñón junction, including a bifurcation in the Irun-Madrid direction and a confluence in the Madrid-Irun direction, all with the aim of maintaining adequate road conditions throughout the corridor of the AP-1 that supports long-distance traffic, both national and international, a corridor that is part of the itineraries E -5 and E-80 of the Trans-European Highway Network.

The estimated amount of the actions, which will be financed by Mitma, is 16 million euros.

LINK BETWEEN THE MEDITERRÁNEO HIGHWAY (A-7) AND THE A-92 HIGHWAY IN VIATOR

The Council of Ministers has authorized the Ministry of Transport, Mobility and Urban Agenda (Mitma) to tender the works contract for the execution of the project "Remodeling of the link between the Autovía del Mediterráneo (E-15/A-7) and the A 92 motorway in Viator", province of Almería, with an estimated value of 32.84 million euros.

The current link between the E-15/A-7 and A-92 highways is configured using a diamond typology with a lower roundabout, with the Granada-Málaga as the only direct movement, through a segregated branch. In this roundabout they connect the A-1000 highway of the Junta de Andalucía, the access to the La Legión Military Base and the A-92 highway towards Granada.

The junction currently presents disturbances in its operation, causing at peak hours the formation of long waiting lines in the trunk of the A-7, mainly in the Almería - Granada movement and, to a lesser extent, in the Murcia-Murcia movement. Grenade.

The action will improve the capacity of the junction by resolving the movements between the A-7 and A-92 motorways, with origin-destination Almería, Murcia and Granada through direct branches, which will have a total joint length of 4.96 km, providing it with greater capacity and improving its level of service. The Council of Ministers has approved the creation of a new specialization course in composite materials in the aerospace industry. Thus, the improvement of the training offer linked to the process of modernization of Vocational Training that the Government is carrying out continues.

This course, the sixteenth designed by the MEFP, focuses on the manufacture of parts and elements of aerospace structures, manually or in production lines, as well as controlling the processes involved, verifying the results obtained, performing advanced maintenance, the preparation and set-up of the installation, machinery and tools.

The duration will be 600 hours and it can be accessed by having a higher degree in Production Programming in Mechanical Manufacturing; Electrotechnical and Automated Systems; Production Scheduling in Metal and Polymer Molding; Industrial Mechatronics; and Automation and Industrial Robotics.

Specialization courses complement the skills of those who already have a vocational training degree and also facilitate lifelong learning. These are training courses developed by the Ministry of Education and Vocational Training in collaboration with leading companies in the sectors involved, which respond quickly to innovations that occur in the productive system and therefore have high employability.

The approval of this degree is part of the expansion of the catalog of titles and the streamlining of its publication to respond to the qualification needs of each productive sector, one of the pillars of the Vocational Training Modernization Plan that develops the government since 2018.

This plan is complemented by the Vocational Training Organization and Integration Law, which received the green light in the Congress of Deputies on December 16 and whose final approval is scheduled for the first quarter of 2022. The law will culminate the transformation and modernization of Vocational Training to put it at the service of students and workers.

CREDIT FOR THE MODERNIZATION OF THE CAIRO METRO

The Council of Ministers has authorized the granting of a reimbursable credit under OECD concessional conditions charged to the Fund for the internationalization of the company, (FIEM) to the National Authority for Tunnels (NAT) in Egypt, to finance the rolling stock modernization project for Line 1 of the Cairo Metro for an amount of up to €159 million.

The object of the contract is the modernization of the rolling stock of line 1 of the Cairo Metro, with the aim of extending the useful life of the 23 train units by 20 years.

The amount amounts to €185M, of which 71.7% corresponds to Spanish goods and services, 14.2% to goods and services from third countries and the remaining 14.1% local expenditure at destination.

The buyer is the National Authority for Tunnels (NAT), a government agency under the jurisdiction of the Egyptian Ministry of Transport, created for the execution of metro line projects in the country. The exporter, Construcciones y Auxiliar de Ferrocarriles, S.A. (CAF) is a multinational group with more than 100 years of experience that has a notable presence in the international market and with a strong focus on Europe. The Council of Ministers has authorized the signing of a fifth addendum to the agreement between the Ministry of Industry, Energy and Tourism and the UTE INDRA SISTEMAS S.A. - SANTA BARBARA SYSTEMS S.A. - SAPA OPERATIONS S.L. (UTE VCR 8X8) regarding the Technological Programs associated with the future 8x8 wheeled combat vehicle.

The fifth Addendum contemplates that the return to the Public Treasury of the amount of the financing provided to the UTE VCR 8x8 within the framework of the Agreement (€91,969,680) will be made in a single annuity in the year 2023 and does not imply any increase of spending over what was previously authorized for this program.

AID FROM THE CAP IN THE YEAR 2022

The Council of Ministers has approved a Royal Decree that modifies another three of December 2014 on the application of the Common Agricultural Policy (CAP), which incorporates the necessary changes to adapt national regulations to certain legislative updates of the European Union (EU). These modifications will allow Spanish farmers and ranchers to receive more than 7,425 million euros in aid in 2022, the last transition year between the previous framework (2014-2020) and the entry into force of the new CAP, on January 2023.

The new standard modifies Royal Decrees 1075/2014, 1076/2014 and 1078/2014, all of them dated December 19, which, in addition to updating the new EU regulations, incorporates some technical adjustments derived from management experience of the CAP in previous years. The 7,425 million foreseen in 2022 include both the European Agricultural Guarantee Fund (EAGF), from which direct aid comes, and the European Fund for Rural Development (EAFRD), which finances the actions of the so-called second pillar of the CAP. The aid application campaign will begin on February 1.

The main modifications of Royal Decree 1075/2014 refer to the definition of "pasture admissibility coefficient" to allow the autonomous communities to establish in their regulations a minimum coefficient value below which said area will not be considered eligible. Likewise, the associated livestock grants are modified, clarifying, in the case of those who start their activity, the procedure for calculating eligible animals, so that the competent authority can apply the most beneficial option for these applicants.

Similarly, management is simplified for the regulatory councils or accrediting entities of quality denominations for legumes, who will not have to submit annually the NIF of registered farmers or those in the registration process, nor the area registered by each one of them. them when the competent authorities already have this information.

Regarding the content of the single application when the term for its submission begins, the Spanish Agrarian Guarantee Fund O.A. (FEGA) will publicize the crop catalog so that farmers can make the declaration correctly. In the case of hemp cultivation, along with the application, proof of the existence of a formalized contract with the processing industry or authorization issued by the Spanish Agency for Medicines and Health Products must be provided.

On the other hand, regarding the deadlines for submitting applications, European regulations now allow them to be set by the member states. To establish common national deadlines that guarantee equal treatment among farmers, April 30 is set as the deadline for submitting a single application, May 31 for its modification, and August 31 for adaptation. of the application in those cases in which the applicant has been notified of an incident derived from preliminary controls or monitoring controls, as well as withdrawing all or part of the parcels from the application.

However, so that there is some flexibility in the dates, which allows changing climatic and meteorological conditions and other circumstances to be taken into account, the autonomous communities may extend the deadline for submitting the single application in their territory more beyond April 30, prior communication to FEGA. They may also extend the deadline for adaptation of the single application beyond August 31, if reasons are given.

Regarding Royal Decree 1076/2014, on the allocation of basic payment regime rights, the convergence mechanism is modified, in order to provide a more gradual accommodation of farms to the future regulatory framework for the application of the Agricultural Policy Common (PAC) from 2023, thus ensuring a smoother transition.

And in relation to Royal Decree 1078/2014, which establishes the rules of conditionality, on the recommendation of the European Commission, the annex that establishes the Good Agrarian and Environmental Conditions of the land is modified, in particular the BCAM 4 (Minimum soil cover) and BCAM 5 (Minimum land management that reflects specific local conditions to limit erosion). With the modification introduced, the exception that affected crop plots smaller than one hectare, and irregular or elongated plots whose minimum dimension in the transversal direction of the slope was less than 100 meters is eliminated.

CAP STRATEGIC PLAN FOR SUBMISSION TO THE EUROPEAN COMMISSION

The Council of Ministers has received the Strategic Plan for the implementation of the Agrarian Policy Common (PAC) in Spain from the year 2023 by the Ministry of Agriculture, Fisheries and Food, and tomorrow, the 29th, it will be sent to the European Commission for approval, thus complying with the provisions of the new regulations.

The Council of Ministers has also approved a bill with the aim of designing an effective management system for this policy.

A fairer, more social and more sustainable CAP

With this new PAC, Spain will have a fairer, more social and more sustainable agricultural policy to promote an agri-food sector that is strategic in the national economy and that will have the necessary budget and tools to face economic challenges, social and environmental aspects of the next decade, also in line with new consumer demands.

The objective is to support professional and family farming so that it improves its competitiveness while promoting profound but gradual changes that remunerate the environmental commitment of farmers and ranchers, while allowing them to increase their efficiency and guarantee some fairer and more efficient payments.

On the 6th, the Official Journal of the European Union published the final text of the three regulations that will govern the CAP in the 2023-2027 period. These new regulations will allow the application of the CAP budget agreed by the European Council in July 2020 and which in the case of Spain represent 47,724 million euros for the entire period 2021-2027.

The delivery to the European Commission of the Strategic Plan, which must be carried out before January 1, 2022, marks the culmination of work begun more than three years ago, during which the ministry has worked together with the autonomous communities to define the content of the proposal, and has maintained constant contact and dialogue with professional agricultural organizations, agri-food cooperatives, and civil organizations of an environmental nature, as well as with the Ministry for the Ecological Transition and the Demographic Challenge and with the services of the European Comission.

All the working documents have been public, open to the participation of any interested party through the web page set up for the purpose. In total, in the preparation of this proposal, nearly 300 meetings have been held and approximately 1,000 written contributions have been analysed.

An initial version of the Strategic Plan has been available since November 30 on the ministry's website for consultation by all interested parties, within the framework of the Strategic Environmental Assessment. After the adjustments that may derive from all the observations and allegations received in the framework of the Public Information and environmental assessment phase and from the Commission's own observations, Spain will propose a definitive text of the Strategic Plan. It is expected that the Commission will approve it at the end of the first half of 2022, so that it will be applicable from January 1, 2023.

The new European regulation represents a substantial change in the CAP, which goes from being a policy based on the description of the requirements that the final beneficiaries of the aid must meet, to a policy based on strategic planning. Now it is oriented towards the achievement of concrete results linked to common objectives for the entire European Union but translated into the specific needs of each state identified in the diagnosis phase.

These objectives are the promotion of a smart, resilient and diversified agricultural sector that guarantees food security; the intensification of care for the environment and climate action, contributing to achieving the climate and environmental objectives of the EU, and the strengthening of the socio-economic fabric of rural areas. In this regard, the specific objective of "promoting gender equality, including the participation of women in agriculture" is included for the first time in the CAP, at the proposal of Spain.

CAP Strategic Plan, key to guaranteeing the viability of the agricultural sector

The Strategic Plan is a decisive instrument to guarantee the viability of our agricultural and livestock sectors, which are the basis of the agri-food system and the main economic engine of rural Spain. To this end, it contemplates support focused on improving the competitiveness of their farms through income aid, advisory services and rural development measures in favor of innovation, improvement of knowledge, investment, the use of technology and the digitization, among other aspects.

The CAP will support small and medium-sized farms in a particular way, making use of all redistribution measures within its reach. Among them, the limitation ("capping") and reduction of the basic aid, which will set the maximum amount of payments at 100,000 euros and provides for a progressive reduction when it exceeds 60,000 euros. However, to avoid distortions of employment, salary and labor costs may be deducted, in any case, no farm will receive more than 200,000 euros of basic income support. It also includes the redistributive payment of aid to larger farms to small and medium-sized ones.

In addition, the Plan includes other aspects that are especially relevant in Spain, such as reducing the gender gap and supporting generational change. For the first time, the social dimension is incorporated into the CAP and Spain, in view of the importance in our sector of the presence of wage earners, intends to do so from the year 2024, one year earlier than is stipulated as mandatory in the regulation.

This is the most ambitious climate and environmental CAP in the history of the EU, in accordance with the commitments acquired within the framework of the United Nations conventions (Biodiversity and Climate Change) and the established roadmap itself in the "European Green Deal". In this way, Spain's Strategic Plan will respond to the environmental needs identified for our country, contributing to the achievement of the objectives of the "Farm to Table" and "Biodiversity for the 2030 horizon" strategies.

Some of these objectives are the reduction of emissions, the increase in the role of carbon sink, the increase in the area dedicated to organic farming and the reductions in the use of phytosanitary products, the loss of soil nutrients and the use of fertilizers and antimicrobials in cattle breeding. In the specific case of Spain, the fight against desertification and erosion, the improvement of the soil structure and its organic matter content or the maintenance of the high biodiversity linked to agricultural habitats, are needs that are of relevant importance. The proposal to be presented to the European Commission allocates about 43% of the total budget to achieve climate and environmental objectives.

CAP management law

The Council of Ministers has also approved today a draft law that establishes the rules for the application and management of the new Common Agrarian Policy (CAP) in Spain, with the aim of enabling a homogeneous application of it throughout the territory national.

The new orientation of the CAP with the design of the national strategic plans makes it necessary to have the appropriate tools that allow a harmonized application of all the measures included in it. The purpose of this draft bill is to implement an effective management and control system and avoid any discriminatory situation for beneficiaries, guaranteeing compliance with European Union regulations within the framework of the CAP.

The law also includes some aspects that until now were included in the community regulations and that, due to the greater subsidiarity granted to the member states in this period, must be developed in national regulations, such as the application of penalties and sanctions in the case that the beneficiaries do not meet the conditions and obligations established for access to aid.

Another noteworthy point is the need to guarantee the protection of the financial interests of the European Union, for which reason a national framework of action is established for those cases in which an undue payment could be made to the beneficiaries in order to achieve a homogeneous application in the national territory, facilitating at the same time the action of the competent administrations in the fight against fraud.

In the framework of the actions to adjust the regulations to some of the reforms introduced in the Regulation of the Common Organization of Agricultural Markets (OCMA) and to comply with the objectives of the CAP, such as the conservation of biodiversity , or the objectives established in the European Strategy "From farm to table" for a fair, healthy and environmentally friendly food system, the sanctioning regime in other agricultural matters related to the CAP is regulated.

RECOGNITION OF THE PRODUCER ORGANIZATIONS AND THEIR ASSOCIATIONS OF THE LIVESTOCK SECTORS OF BEEF, SHEEP AND GOATS

The Council of Ministers has approved a Royal Decree which regulates the recognition of producer organizations and their associations in the beef and sheep meat farming sectors, and establishes the conditions for contractual negotiation by these organizations and their associations.

The main objective of this Royal Decree is to strengthen the negotiating position of beef, sheep and goat meat producers and thus achieve a higher remuneration for the livestock sector and a better distribution of value throughout the food chain. All this within the framework of community regulations and free competition in the market.

Support for producer organizations

With this initiative, the Ministry of Agriculture, Fisheries and Food continues its strong support for the establishment of producer organizations in the agricultural sector.

In this sense, the reform of the Common Agricultural Policy (CAP), which will enter into force in 2023, recognizes the fundamental role of producer organizations in concentrating supply and improving marketing and planning of production, as well as in adapting production to demand, optimizing production costs and stabilizing producer prices. For this reason, it includes them as key structures to improve the position of the primary sector in the chain, thus contributing to meet the objectives of this community policy.

In this sense, the recommendations made by the European Commission to our country in December 2020, within the framework of the "Farm to Fork Strategy", and which have been taken into account in the preparation of the Strategic Plan for the application of the CAP in our country, include the legislative development for the recognition of producer organizations in those sectors that do not yet have regulations in this regard.

FINANCING FOR BLUE ECONOMY PROJECTS

The Council of Ministers has approved a Royal Decree establishing the regulatory bases for subsidies for 2022 and 2023 to groups of entities that carry out projects in the field of blue growth in the fishing and aquaculture sector, within the framework of the Recovery, Transformation and Resilience Plan (PRTR). The budget for these grants is one million euros in each of the two years in which they will be called.

With this line of subsidies from the Ministry of Agriculture, Fisheries and Food, it will be possible to finance projects of blue growth activities in the fishing and aquaculture sectors, which entail the modernization, updating and sustainable improvement of these, including the entire chain processing and marketing of their products, as well as their competitiveness and productivity.

This line of subsidies is intended for groups of entities led by one of the Knowledge Spaces that maintain a general collaboration protocol on the blue economy with the General Secretariat of Fisheries.

In the granting of the subsidies, issues such as the promotion of equality, the promotion of training techniques and those that facilitate generational renewal, innovation in occupational health, diversification with complementary activities to the fishing and shellfishing, promote actions for local development that provide added value to the fishing sector and make visible and give prestige to it and its workers.

The aid budget for this measure is spread over two years. For the year 2022, 1 million euros are contemplated, and another million for 2023, with the possibility of making advance payments in either of the two years, and with the idea of ​​covering up to 100% of eligible expenses.

This line of subsidies is one of the measures contemplated in the Plan to Promote Sustainability, Research, Innovation and Digitization of the Fishing Sector designed by the Ministry of Agriculture, Fisheries and Food (MAPA) and included in the program of actions that manages this within the Plan for the Recovery, Transformation and Resilience of the Spanish Economy (PRTR).

NEW NATIONAL SECURITY STRATEGY

The Council of Ministers has given the green light to the Royal Decree approving the Strategy of National Security, the strategic reference framework of the National Security Policy.

Although the current strategy dates from 2017 and the National Security Law establishes its renewal every five years, it has been decided to review the text in advance to adapt it to the current context characterized by greater geopolitical competition and a socioeconomic environment marked by consequences of COVID, as well as the acceleration of the transformation caused by technology and the ecological transition.

The objectives of the new strategy, which has a more integrated, proactive and preventive-oriented design, are to advance in crisis management, favor the security of technological capabilities and strategic sectors, and develop preventive, detection and response to hybrid threats.

The actions to develop these objectives are articulated around three axes: the protection of people and order; the promotion of prosperity and well-being and participation in international security.

Among the new actions, some stand out such as the modernization of the epidemiological surveillance system, the development of a Comprehensive Security Plan for Ceuta and Melilla, the preparation of a National Strategy to combat disinformation campaigns, the creation of a Spanish Space Agency with a component dedicated to National Security or the incorporation of the SDGs.

REPORT ON THE ACTION PLAN FOR PRIMARY AND COMMUNITY CARE 2022-2023

The Council of Ministers has approved the report on the Action Plan for Primary and Community 2022-2023, approved by the Interterritorial Council of the National Health System on December 15.

The Plan has been defined in 13 objectives and 12 key points, each one of them with several actions to be fulfilled before 2023 until a total of 52.

Its execution date is 2022-2023 and it has finalist financing for AP both in the General State Budgets and in the contributions made by the Autonomous Communities themselves.

Among other aspects, the Plan includes the creation of the professional category of Family and Community Nurse in PC in the year 2022 and encourages the appointment of specialist nurses and sets the goal of reducing temporary employment in Primary Care below the 8%

The Plan marks the improvement of procedures to increase the resolution capacity or the acquisition of diagnostic equipment and the development of necessary continuous training. Work is also being done on optimizing administrative processes so that they are more agile and decisive.

The Plan increases teleconsultation projects, access to medical images, issuance of individualized alerts and remote detection of risks through IT and Big-Data tools.

The approved document will update the common portfolio of services in Primary Care, especially with regard to the indication and performance of diagnostic procedures and in the Community Care Service. At this point is added the progressive expansion of the common portfolio of oral health services.

It also joins in the follow-up of the actions included in the Health Strategies of the SNS with a special approach to chronicity, patient safety and cancer prevention.

The objective of the document reflects the development of a Community Health Strategy at the level of each autonomous community that is complemented by a training strategy in the biopsychosocial approach and community action.

In addition, strategies and coordination mechanisms will be promoted between the health system and the neighbourhoods, municipalities and autonomous communities, understanding health as a whole and with significant citizen participation.

In the document there are initiatives related to the increase in R+D+i and the empowerment of Primary Care professionals, among other aspects.

LEGAL DEPOSIT LAW

The Council of Ministers has approved the draft law that modifies Law 23/2011, of June 29, of legal deposit to adapt it to the current situation of Spanish editorial production, allowing it to play a more effective role in the conservation of the national edition and optimizing the management of conservation centers.

The modification includes several improvements among which the delivery by publishers of digital files prior to printing stands out. This will facilitate the preservation and access to documents and will mean not having to digitize these copies in the future.

New documentary typologies are also incorporated as legal deposit objects, among which video games stand out; print-on-demand publications; commercial catalogs from bookstores, publishers and auctions, as well as bookmarks; and audiovisual works and documents; in coherence with the Intellectual Property Law.

Similarly, as a novelty, the recognition of the Spanish Film Library as a conservation center is included, whose objectives are the recovery, investigation and conservation of Spanish cinematographic heritage and its dissemination.

The text also incorporates the changes derived from the approval in 2015 of Royal Decree 635/2015, of July 10, which regulates the legal deposit of online publications, which facilitated the conservation of digital heritage .

The preparation process has been carried out in collaboration with the Autonomous Communities and the main agents of the sector: the Federation of Publishers Guilds of Spain, the Spanish Association of (AEVI) and the Spanish Center for Reprographic Rights (CEDRO).

The legal deposit

Legal deposit is the regulation that allows the National Library of Spain (BNE) and the conservation centers of the Autonomous Communities to collect copies of publications of all kinds published on any kind of support (both physical and online). , in order to comply with the duty to preserve the Spanish bibliographic and documentary heritage.

Also by virtue of the legal deposit, the BNE and the Autonomous Communities are responsible for the conservation of heritage that is born digital, online publications, both websites and electronic books or magazines.

Each year through legal deposit, the BNE receives around 400,000 physical documents thanks to this standard and the BNE already has 120,000 digital books and around a petabyte of collected Spanish websites.

LAIA PALAU WILL RECEIVE THE GRAND CROSS OF THE ROYAL ORDER OF SPORTING MERIT

The Council of Ministers has approved the granting of the Grand Cross of the Royal Order of Sports Merit to the basketball player Laia Palau. The base, which announced its withdrawal from the Spanish National Team last November, thus joins the select group of athletes who hold the highest State decoration in sports, including Rafa Nadal, Arantxa Sánchez Vicario, Xavi, David Cal or, most recently, Pau Gasol.

IBEROAMERICAN PROGRAM OF SCIENCE AND TECHNOLOGY FOR DEVELOPMENT (CYTED) OF THE IBEROAMERICAN GENERAL SECRETARIAT (SEGIB)

The Council of Ministers has authorized the payment of the Voluntary contribution to the Ibero-American General Secretariat (SEGIB) for the Secretariat of the Ibero-American Science and Development Program (CYTED), corresponding to 2021, for an amount of 550,000 euros.

The Ibero-American Science and Development Program (hereinafter CYTED) has its origin in an Institutional Framework Agreement, signed on May 11, 1984 by 19 Latin American countries (Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Cuba, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, Dominican Republic, Uruguay and Venezuela), Portugal and Spain.

Since its creation, a General Secretariat was established, which has permanent headquarters in Madrid and whose maintenance costs are assumed by Spain, which provides the adequate material and human resources for its operation. The contribution that the Ministry of Science and Innovation grants to the SEGIB for the CYTED Program, by virtue of this agreement, is for the support of the same and its Secretariat during the year 2021.

SUBREFLECTORS OF THE SATELLITE DISHES OF THE ORGANIZATION 'SQUARE KILOMETRE ARRAY OBSERVATORY' (SKAO)

The Council of Ministers has authorized the payment of the voluntary contribution of Spain to the construction project of the subreflectors of the satellite dishes of the organization 'Square Kilometer Array Observatory' (SKAO), which will be installed in the Republic of South Africa, for an amount of 4,400,000.00 euros, charged to the Recovery and Resilience Mechanism (MRR).

In 2011, the SKA organization was created, based at the Jodrell Bank Observatory (Manchester, United Kingdom) with the mission of building and operating the SKA telescope, which will be made up of two large networks of radio telescopes in South Africa and Australia that will operate as a single observatory. The SKA will allow astronomers to make highly detailed observations of the sky much faster than any other system currently in existence.

Currently it has the participation of 16 countries Germany, Australia, Canada, China, South Korea, Spain, France, India, Italy, Japan, South Africa, Sweden, Switzerland, the Netherlands, Portugal and the United Kingdom.

Ten years later, on February 4, 2021, the SKA organization became an intergovernmental organization, under the name SKA Observatory (hereinafter, SKAO), by signing a treaty that has already been ratified by seven countries (Australia, China, Italy, the Netherlands, Portugal, the United Kingdom and South Africa) and it is expected that the adhesion of the remaining future members will take place gradually, as the approval processes are concluded in each country.

Spain joined the SKA Organization, as an associate member, in June 2018, and has participated since then in all advisory and governing bodies of the SKA construction project. The Ministry of Science and Innovation has since expressed our country's interest in participating fully and formally in SKAO, so that the application of the Kingdom of Spain to be a full member was officially presented to the SKAO Council at its June meeting. of 2021, proposing to the members the approval, by written procedure, of the membership and the provisional application of the Treaty in Spain until its entry into force. On July 13, 2021, Spain was notified of the unanimous approval of said request.

HARMONI INSTRUMENT OF THE EUROPEAN SOUTHERN OBSERVATORY (ESO)

The Council of Ministers has authorized the signing of an agreement with the European Southern Observatory (ESO) in relation to to the Spanish contribution for the project for the design, manufacture and commissioning of different components of the HARMONI instrument of this observatory, for an amount of two million euros.

The European Southern Observatory (hereinafter ESO, for its acronym in English, European Southern Observatory), is an international organization that was founded in 1962, and of which Spain has been a member state since 2006. According to its contribution , our country has a share of approximately 8% of the assets and observation time offered by the organization.

ESO is a world reference in scientific research and technical development in the field of astronomy. It carries out an ambitious program aimed at the design, construction and operation of powerful ground-based astronomical observation facilities, which make up a set of optimal tools to achieve important scientific discoveries in astronomy.

Currently, it is embarking on the construction of the Extremely Large Telescope (or ELT, for its acronym in English; Extremely Large Telescope), a telescope with a primary mirror of 39 meters in diameter that will be the most important among the telescopes of available optical and near-infrared range and, furthermore, one of the most ambitious astronomical projects in the world. In fact, the ELT is called to revolutionize our perception of the universe, since it will allow us to face several questions still unresolved in the field of astronomy.

One of the first instruments to be installed on the ELT is a high spatial resolution, integral field infrared/optical spectrograph, called HARMONI. This instrument, which will represent a true technological display, will be able to operate at the diffraction limit of the ELT in the near infrared and will have great versatility, since it will allow different types of astronomical observations to be addressed through the timely and necessary adaptation of its angular resolution, sensitivity, field of view etc.

The design and construction of this instrument is carried out by the HARMONI International Consortium, which has been contracted by ESO for this purpose and which has the participation of some of the most prestigious European institutes in the field of astronomical instrumentation, such as ATC Edinburgh, Durham University, CRAL-Lyon and LAM-Marseille, as well as the University of Michigan (USA). The consortium is led by the University of Oxford and Spain also participates very actively through the Instituto de Astrofísica de Canarias (IAC) and the Center for Astrobiology (CAB, INTA-CSIC).

Currently the development of HARMONI is in the final design phase, which consists of the consolidation of a detailed manufacturable model in which those technological aspects identified as "risk" in previous phases have been resolved. The total cost of developing and putting HARMONI into operation is estimated at €28 M in hardware.

Our research institutions and technology companies have extensive experience in astronomical instrumentation. The agreement approved today seeks to provide the Spanish partners in the HARMONI Consortium (IAC and CAB), through ESO, the necessary funding for Spanish technology centers and research groups to participate in the design and manufacture of prototypes and highly necessary specialists for the commissioning of the HARMONI instrument.

EUROPEAN RESEARCH INFRASTRUCTURES CONSORTIUM (ERIC) EUROPEAN SOURCE OF SPALLATION (ESS)

The Council of Ministers has authorized the signing of an agreement with the Consortium of European Research Infrastructures (ERIC) European Spallation Source (ESS), for the construction, installation and start-up project of the different ESS equipment, for which the Government will contribute 14, 3 million euros, charged to the Recovery and Resilience Mechanism (MRR).

The ERIC Fuente Europea de Espalación is a European consortium of research infrastructures, to which Spain joined as a full-fledged founding member in April 2018, which works on the construction and start-up of the scientific-technological infrastructure more Europe of the next decade. The European Spallation Source or ESS will constitute the most powerful neutron source in the world, with 5 MW of power and a set of 22 instruments, which will allow a very detailed study of the structure of matter, with great repercussions in numerous scientific disciplines such as such as fundamental physics and biology.

This is a genuinely pan-European facility, participated in by thirteen partner countries, and considered strategic by the European Union. Currently, Spain participates in all the advisory and government bodies of the ESS construction project, and makes its contribution through the ESS Bilbao neutron technology center, responsible for the work related to the in-kind contributions agreed with ESS ERIC .

In addition to the regular contribution, the States participating in ESS ERIC have decided to finance the manufacture of new equipment for the source. Specifically, Spain would assume the provision of new high-tech equipment that would be used in the construction, testing and commissioning of the accelerator, the target and the ESS instruments, charged to the appropriated MRR funds.

ATLAS, CMS AND LHCB EXPERIMENTS AND ISOLDE AND N-TOF PROJECTS OF THE EUROPEAN ORGANIZATION FOR NUCLEAR RESEARCH (CERN)

The Council of Ministers has authorized the signing of an agreement with the European Organization for Nuclear Research (CERN) for the Spanish contribution to updating the ATLAS, CMS and LHCb experiments and to the new ISOLDE and n-TOF projects, and the contribution to the aforementioned body has been authorized for an amount of 6,340,000.00 euros, charged to the Recovery and Resilience Mechanism (MRR).

CERN is an international organization founded by virtue of the International Paris Convention, signed on July 1, 1953, and is headquartered in Geneva (Switzerland). Currently, it is made up of 23 Member States. Spain has been a member of CERN without interruption since November 15, 1983 and currently contributes a contribution of approximately 7.4% of the organization's budget.

The basic objective of research at CERN is the study of the ultimate constituents of matter and the fundamental forces through which they interact. The technique used for this are particle accelerators. CERN constitutes an articulated set of accelerators whose final link is the Large Hadron Collider (LHC), with its four gigantic detectors: ATLAS, CMS, LHCb and ALICE.

Our research institutions and technology companies have extensive experience in the development of projects and the design of the instrumentation necessary for experimentation in the area of ​​high-energy particle physics developed at CERN.

It is therefore necessary to provide the Spanish technology centers and research groups that collaborate with CERN with the necessary funding so that they can participate in the tasks of designing and manufacturing prototypes and highly specialized equipment necessary to update their large detectors and of other new projects. The training and good positioning of our industry when it comes to developing this type of equipment would also mean a high level of return for the bidding Spanish entities and for our science industry in general.

NATIONAL REFUGEE RESETTLEMENT PROGRAM FOR 2022

The Council of Ministers has approved the National Refugee Resettlement Program in Spain for the year 2022 For yet another year, a commitment that Spain has made materializes with a limit that, in the new Programme, is established in the reception of up to 1,200 refugees throughout the next year.

The Council of Ministers annually approves the National Resettlement Programs, which offer protection to refugees from countries affected by conflicts and serious humanitarian crises. The commitment of the Government of Spain with this program is included in the global resettlement priorities identified by the United Nations High Commissioner for Refugees (UNHCR) and the European Union, and the Ministry of Inclusion, Social Security and Migrations is in charge to offer reception within the framework of the International Protection Reception System.

Inclusion promotes, in addition to welcoming these families, their full support through the gradual implementation of Community Sponsorship programs, in collaboration with UNHCR and different autonomous communities. The development, consolidation and extension of this reception tool constitutes an essential objective for the Ministry throughout 2022.

The Government of Spain confirms with the approval of this new program a firm commitment to refugees, which will be maintained throughout 2022. Thus, over the next year six refugee selection missions have been planned by of the Ministry of Inclusion, including online interview modalities for families if sanitary conditions prevent physical displacement.

Currently, two arrivals to Spain from Lebanon from countries in conflict are already scheduled on the calendar, which will take place during the first quarter of 2022 with a total of 658 people, a figure that guarantees a high execution of the commitment assumed in this new Program.

The reception system is structured around its own places (in the Refugee Reception Centers-CAR-) and centers managed by entities with state funding, with a capacity of more than 10,000 places throughout the national territory.
